I think 'example #2' applies in this situation. you can report it to eBay if you want to make an example of this person.
Hope This Helps.
PS - Auction ends @ 23-Jul-07 16:39:08 BST
PPS - Please can I reply to their email with - 'Oh just wondered why you were using a copyrighted photograph that someone else took!' PLEASE PLEASE PLEASE can I huh?

Well if that's the answer you got I shall just have to write my own E-mail.
I sent this:
I understand that someone asked you if the fish photographed is in fact the fish that is for sale. Your answer was "Yes". This is a blatant lie and you know it because I am Martin Thoene who's name you blanked out at the lower left of the photograph. I object strongly to you using my photograph for your own gain and it is blatant fraud to suggest to purchasers that this is the fish they are buying.
The information is pasted directly from Loaches Online too which of course you know.
Martin.

The seller has withdrawn the listing using Martin's photo
They also put this on the original listingThe seller ended this listing early because of an error in the listing.
This item or one like it has been relisted.
TCOn 22-Jul-07 at 05:24:01 BST, seller added the following information:
please be aware that this is not the the fish you will get but it is identical

One of my own eBay rules is never to buy off someone who can't spell simple words properly.
Unless of course it means I'm getting an absolute steal!!

I replied:
Martin. You're going to report ME to E-bay? I'm the one who's picture was stolen and you're the E-bay seller telling people that my fish is the one for sale. You're full of it mate. At least your other half seems like a decent person. I hope you got sh*t from her. Thank her from me for her nice reply.
You are more than welcome to report me to E-bay. I'm sure they will be most impressed with your stupidity and ethical habits which totally contradict their rules of use.

My personal view is that you (or anyone else) may use any of my pictures for such use. I don't believe that others would object to that kind of use either. It's very flattering to have someone to want to use your pictures that way.
There's a world of difference between using someone's pictures for your personal pleasure and using the same pictures for personal profit or to benefit one's own website be it commercial in nature or not.
If someone wants to use one of my pictures on their website and asks nicely for permission, I usually have no problem giving it. I will however vet the site for quality before giving that permission. If a site is not providing a good quality of information generally, then I would not want my pictures associated with it and would refuse permission. I take the pictures to enhance people's understanding of the fish and for identification purposes. If that leads to a greater possibility of furthering other's knowledge then it's acheiving my goal.
Jim Powers has carte-blanche permission from me to use any of my photos in his lectures on Hillstream Loaches and there care that he does at aquarium club meetings. I get full credit for the pics and he's always promoting the reading of my articles so it's all part of spreading the word.
By enthusing people visually one can hopefully make them take the proper care required for keeping these fish.
